General Information
weTours e.U. – Sightseeing Tours & Travel Agency Services
weTours e.U. is a licensed Austrian travel agency (GISA 34528365) offering sightseeing tours, private tours, transfers and related services. All services are provided exclusively on the basis of these Terms and Conditions.
1. Formation of Contract
A binding contract is established once a booking confirmation with a booking reference number has been issued. You will receive this confirmation by email after completing the booking. All agreements, amendments, or special requests must be made in writing (email is sufficient).
2. Cancellations by Customers
- 50% of the total price for cancellations 14 days or less before the event
- 100% of the total price for cancellations 3 days or less before the event
3. Cancellations by the Operator
- failure to reach the required minimum number of participants (as stated in the booking confirmation)
- unforeseen operational restrictions
- staff shortages
- technical issues
- safety concerns
- Rebook the same tour for another time or date
- Join an alternative tour
- Receive a full refund
4. Bookings via OTAs (Viator, GetYourGuide, TripAdvisor, etc.)
If you book a tour via an Online Travel Agency (OTA) such as Viator, GetYourGuide, TripAdvisor, or any other third-party platform, the terms, cancellation policies, and payment rules of the respective platform apply. The contractual relationship regarding the booking process is between you and the OTA. These Terms and Conditions apply from the moment the service is delivered by weTours e.U.
5. Force Majeure
- the contractual relationship remains valid
- the service may be rescheduled
- refunds may not be possible
6. Payment Terms
Unless otherwise agreed in writing, all tours must be paid in advance via credit card or PayPal. In exceptional cases, payment in cash to the tour guide may be possible. Prices may change until the moment of booking. Obvious misprints or calculation errors may be corrected even after booking.
7. Duty of Supervision
For tours involving children, minors, or persons requiring supervision, the customer remains fully responsible for supervision throughout the entire duration of the event. The operator assumes no supervisory duties.
8. Child Seats
Customers travelling with babies or young children must bring and correctly install a suitable child seat for the booked vehicle. If no compliant child seat is available, the service cannot be provided, and refunds may not be possible.
9. Tour Duration
All indicated tour durations are approximate and may vary due to traffic, weather, and local conditions.
10. Itinerary & Route
The operator reserves the right to change or adapt the tour route at any time for operational, safety, or traffic-related reasons. No compensation can be claimed for such changes.
11. Hotel Pick-Up
Hotel pick-up times are approximate and may be affected by traffic or access restrictions. If the requested pick-up location cannot be served, an alternative meeting point will be provided. Guests must arrive at the pick-up location on time. Late arrival may result in loss of the reservation without refund.
12. Exclusion from Participation
The operator may exclude individuals from a tour if their behaviour is disruptive, threatening, offensive, or endangers other participants or staff. Such exclusion does not entitle the customer to any refund or further claims.
13. Optional Add-On: Professional Photography Service
For selected tours, weTours offers an optional add-on featuring professional photographic coverage by experienced, professional photographers. This service can be added during the booking process and is provided exclusively by trusted photographers engaged by weTours, who perform their services on behalf of and for the account of weTours.
Delivery of the Photographs
All photographs taken during the tour will be made available within 24 hours after the end of the tour via a digital gallery in a password-protected area on the weTours website. Access details for the gallery will be sent by email to the contact information provided by the guest at the time of booking.
Copyright and Usage Rights
a) Copyright
The copyright and moral rights to all photographs created during the tour remain exclusively with the respective photographer.
b) Usage Rights Granted to weTours
The photographer grants weTours a non-exclusive, worldwide, perpetual, and unrestricted right to use the photographs for all purposes related to the business activities of weTours, including but not limited to marketing, advertising, website content, social media, print materials, press relations, and distribution via booking platforms.
c) Guest Usage Rights
weTours grants guests a non-exclusive, non-transferable right to use the provided images for private, non-commercial purposes only, including personal memories and private social media accounts. Commercial use by guests is not permitted.
d) Commercial Use and Redistribution
Any commercial use, redistribution, sale, publication, licensing, or modification of the images by guests requires the prior written consent of weTours and, where applicable, the photographer.
Guest Consent
By booking the photography add-on, guests consent to being photographed during the tour and to the use and distribution of the photographs in accordance with the provisions above. Guests who do not wish to be photographed must inform weTours prior to the start of the tour. weTours will make reasonable efforts to accommodate such requests but cannot guarantee complete exclusion from all photographic material.
14. Liability
- delays or non-performance caused by circumstances beyond its control
- loss, damage, or theft of personal belongings or valuables
- actions of third-party service providers (e.g., vehicles or drivers provided by partner companies)
- accidents or incidents caused by third parties or unavoidable external events
15. Dispute Resolution

16. Governing Law and Jurisdiction
For contracts not concluded with consumers, Austrian law applies exclusively, excluding its conflict-of-law rules. Place of jurisdiction is the competent court in Salzburg, Austria. Place of performance is 5020 Salzburg.
17. Changes to These Terms
weTours e.U. reserves the right to update, modify, or amend these Terms and Conditions at any time. All information is provided without guarantee.
